The hearing of the case against the ‘Supreme Court Practice and Procedure Act’ in the Supreme Court was adjourned till next week. During the hearing, the Chief Justice remarked that it is happy that the Parliament and the government are amending the same laws, the government should consult the Supreme Court regarding the legislation of the judiciary. An 8-member larger bench headed by the Chief Justice of Pakistan heard the case, the bench includes Justice Ijazul Hassan, Justice Muneeb Akhtar, Justice Mazahar Ali Akbar Naqvi, Justice Muhammad Ali Mazhar, Justice Ayesha Malik, Justice Hasan Rizvi and Justice Shahid Waheed. When the hearing started today, the Chief Justice of Pakistan said that you had something to say, Mr. Attorney General. The Attorney General said that we have two laws, one is the Supreme Court Review of Order and Judgment Act, the other is the Supreme Court Practice and Procedure Act, the review and advocacy clauses in both laws are similar. The Procedure Act is more extensive, it contains provisions relating to the internal affairs of the Supreme Court. The Chief Justice said that he can ask the parliament to look at the harmonization of the two laws, he welcomes your proposal, it is good that the parliament and the government are amending the same laws, the government should be protected from the legislation of the judiciary. The Supreme Court should be consulted. Justice Muhammad Ali Mazhar said that it has to be seen that if the laws are the same then it can be resolved or not, if the laws are similar then it will be a waste of time to hear the applications related to the full court. The Attorney General said that the court can refer the matter to the Parliament. The Chief Justice said that he will not send this matter to the Parliament, if the Parliament and the government give any suggestion, they will consider it. The Chief Justice directed the Attorney General to listen to someone else until he takes instructions from the government. The petitioner’s lawyer said that the court had sought the action of the Parliament. The Chief Justice of Pakistan said that according to the newspapers, the parliament refused to provide the proceedings to the court, but we have taken the proceedings of the parliament from their website. The Chief Justice said that he will hear the case next week, he apologizes to all the lawyers who have come from Karachi after a long journey, the weather is pleasant here, I hope everyone will enjoy it.
