The federal government has challenged the 3 judges presence in the bench for the hearing of the Audioleaks Commission. The federal government has filed a petition against Chief Justice Umar Atta Bandial, Justice Ijaz-ul-Ahsan, Justice Muneeb Akhtar. The federal government submitted a miscellaneous application in the case of applications against the Audio Leak Commission. In the petition, a position has been taken that Chief Justice Umar Atta Bandial, Justice Ijaz-ul-Ahsan, Justice Muneeb Akhtar should not hear the audio leak case. The three honorable judges refused to sit in the five-member larger bench. In the petition, it has been requested to form a new bench to hear the petitions against the Audio Leak Commission of the federal government. During the hearing on May 26, the objection raised against the Chief Justice was not accepted. The petition states that an audio before the inquiry commission is related to the pleasure of the Chief Justice. According to court decisions and Judges’ Code of Conduct, a judge cannot hear the case of his relative. It has been further stated in the petition that in the past, Chief Justice Iftikhar Chaudhry had recused himself from the bench in the Arsalan Iftikhar case. The alleged audio leaks are also related to Justice Ijaz-ul-Ahsan and Justice Muneeb Akhtar.
