{"id":5737,"date":"2023-04-03T08:09:01","date_gmt":"2023-04-03T08:09:01","guid":{"rendered":"https:\/\/www.diplomacypakistan.com\/?p=5737"},"modified":"2023-04-03T08:09:01","modified_gmt":"2023-04-03T08:09:01","slug":"three-member-sc-bench-resumes-election-delay-case-hearing","status":"publish","type":"post","link":"https:\/\/www.diplomacypakistan.com\/?p=5737","title":{"rendered":"Three-member SC bench resumes election delay case hearing"},"content":{"rendered":"<p>The Supreme Court on Monday resumed hearing the PTI petition challenging the Election Commission of Pakistan\u2019s decision to postpone polls in Punjab till Oct 8 as the coalition government submitted a \u201cconcise statement\u201d in SC urging the bench to recuse itself from hearing the case.<br \/>\nA three-member special bench comprising Chief Justice of Pakistan Umar Ata Bandial, Justice Ijaz-ul-Ahsan and Justice Muneeb Akhtar has resumed hearing in the suo motu as well as the Pakistan Tehreek-e-Insaf\u2019s (PTI) plea challenging the order of the Election Commission of Pakistan (ECP) for postponing the Punjab election to October 8, citing security reasons.<br \/>\nThe court has also summoned the secretaries of interior and finance today.<br \/>\nMeanwhile, in the latest development, the federal government on Monday filed a fresh plea in the top court seeking the reconstitution of the bench.<br \/>\nThe federal government has requested the court to dismiss the PTI\u2019s petition. It has also objected to the bench hearing the case.<br \/>\nThe miscellaneous plea was filed by Attorney General for Pakistan Mansoor Usman Awan.<br \/>\nThe petition says that after the decision of Justice Qazi Faez Isa, the hearing cannot continue. The CJP and Justice Munib have already decided the election case, it observes.<br \/>\nIt further says Justice Ijazul Ahsan has already made his mind clear by writing a note for taking suo motu notice. Justice Ahsan also recused himself from the hearing in the initial stages.<br \/>\nThe federal government pleads that it would be appropriate if the CJP and Justice Munib Akhtar also recuse themselves from hearing the case. Judges who have already heard the case should not be a part of the bench.<br \/>\nThe judges who have not heard the case before should be on the bench, it pleads.<br \/>\nOn the other hand, CJP Bandial quashed PTI leader Fawad Chaudhry\u2019s petition seeking opening of Red Zone ahead of the hearing.<br \/>\nFawad said Red Zone has been sealed, and it seemed as if it was Gaza. He added lawyers were also not being allowed to enter the court. Clashes are erupting at the entrance to the Red Zone.<br \/>\nThe CJP observed the government and administration were taking security measures, adding it is not necessary for hundreds of lawyers to be present.<br \/>\nDuring hearing of the plea, Justice Muhammad Ali Mazhar remarked that \u201cthe situation has already become complicated after the suo motu notice, and yet you wanted us to take notice again\u201d.<br \/>\n\u201cLawyers could come to the court premises after proper identification,\u201d remarked CJP Bandial.<br \/>\nTo prevent any sort of law and order situation, the capital police has deployed 700 police personnel in the Red Zone, while only the people concerned will be allowed to enter the high security zone.<br \/>\nA significant number of lawyers have gathered outside the apex court in response to the call of the bar associations to show their support for CJP Bandial.<br \/>\nSevere traffic jams have been reported on Club Road, Kashmir Chowk, Srinagar Highway, Marriott Chowk and Margalla Road.<br \/>\nPeople going to offices are stuck due to a lack of alternative routes. A large number of lawyers have reached the Constitution Avenue.<br \/>\nThe Islamabad Capital Police spokesperson says entry into the Supreme Court is being allowed only after thorough checking. Lawyers and journalists have been asked to get themselves identified before entering the court.<br \/>\nLawyers have been requested not to block roads, the spokesman said. He added there were threats of terrorism in the capital city.<br \/>\nMeanwhile, in a crucial huddle presided over by Prime Minister Shehbaz Sharif on Saturday, the ruling coalition unanimously expressed no confidence in the existing bench and also indicated it may boycott the hearing after the Pakistan Muslim League \u2013 Nawaz (Supremo) Nawaz Sharif put weight behind boycotting the proceedings after the rejection of a full court plea.<br \/>\nDuring the presser, Fazl added that the chief justice and the other two judges should morally recuse themselves from this case. The PDM president alleged that a few judges want to provide relief to Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan, whose party has filed a plea against the delay in the polls.<br \/>\nPTI has rejected the declaration of the PDM alliance meeting that agreed to boycott the three-member bench.<br \/>\nPTI senior leader Fawad Chaudhary, while reacting to the declaration of the PDM meeting, said that the meetings and declarations of \u2018fascist criminals\u2019 have no status.<br \/>\n\u201cInstead we that PDM, which created chaos and excitement in the country, would apologize for the deaths of two dozen citizens who died in free flour queues.
