{"id":25667,"date":"2025-07-08T06:08:35","date_gmt":"2025-07-08T06:08:35","guid":{"rendered":"https:\/\/www.diplomacypakistan.com\/?p=25667"},"modified":"2025-07-08T06:08:35","modified_gmt":"2025-07-08T06:08:35","slug":"ihc-set-to-hear-pti-ps-petition-against-ecp-notification-today","status":"publish","type":"post","link":"https:\/\/www.diplomacypakistan.com\/?p=25667","title":{"rendered":"IHC Set to hear PTI-P\u2019s petition against ECP notification today"},"content":{"rendered":"<p>The Islamabad High Court (IHC) is set to hear on Tuesday a petition filed by the Pakistan Tehreek-i-Insaf Parliamentarians (PTI-P), challenging the Election Commission of Pakistan\u2019s (ECP) July 2 notification regarding the allocation of 21 reserved seats in the Khyber Pakhtunkhwa (KP) Assembly. PTI-P, under the leadership of Pervez Khattak, contends that the ECP unlawfully denied the party its rightful share of reserved seats by relying on what it claims is an inaccurate count of general seats won by PTI-P in the February 8 general elections. In its plea, the party has requested the court to suspend the ECP notification, arguing that allowing the notified lawmakers to take oath and participate in assembly proceedings would result in &#8220;irreversible prejudice&#8221; and render the party\u2019s main constitutional petition ineffective. The PTI-P contends that the ECP\u2019s March 4 notification erroneously recorded the party as having won only one general seat in KP, when in fact it had won two \u2014 PK-73 and PK-103. This miscalculation, the party says, resulted in the loss of at least three reserved seats for women and non-Muslims that should have been allocated to PTI-P under the system of proportional representation. Despite this discrepancy, the ECP went on to issue the July 2 notification allocating the reserved seats based on what PTI-P describes as a \u201cfundamentally flawed\u201d premise. The dispute over the allocation of reserved seats had also been under review in the Pe\u00ad\u00adshawar High Court. The PHC had initially granted a stay on the oath-taking process on the petition filed by PTI-P. However, during a subseq\u00adu\u00ade\u00adnt hearing, a two-member PHC bench comprising Just\u00adi\u00adc\u00ad\u00ades Syed Arshad Ali and Dr Khu\u00ad\u00adrshid Iqbal questioned how PTI-P could maintain litigation in PHC while a similar matter was pending before the IHC. The PTI-P\u2019s counsel, Advocate Sultan Mohammad Khan, later informed the court that the parliamentary leader Arbab Mohammad Waseem, who had filed the PHC petition, was unaware of the IHC proceedings.
